Progress Tours is registered with the State of Florida as a Seller of Travel. Registration No. ST-[REGISTRATION NUMBER].

1. About Progress Tours and This Agreement

1.1. Who we are. Progress Tours ("Progress Tours," "we," "us," or "our") is an American receptive tour operator, founded in 1988 and located at 2857 SW 27th Ave, Miami, FL 33134, USA. Progress Tours sells receptive tourism products in the United States, including guided circuits and tours in the USA and Canada, hotel accommodations, transfers and transportation, charters, corporate and incentive travel, concierge services, and related travel services (collectively, the "Services"), mainly to travel agencies, tour operators, and travel professionals (business-to-business) and, on request, to direct clients by Invoice. Progress Tours is not a retail travel agency. These terms apply to agencies and direct clients alike, except where a section applies only to travel agencies.

1.2. Binding agreement. You are entering into a legally binding agreement. These Terms and Conditions, together with our Privacy Policy, each Invoice, each booking confirmation and voucher, and any product-specific conditions disclosed to you before payment (together, the "Agreement"), govern every quote, booking, purchase, and use of the Services, whether made through progresstours.com, by email, by telephone, or by WhatsApp.

1.3. How you accept. You accept this Agreement by any of the following: (a) clicking "I Accept," "Book," or a similar button; (b) checking the acceptance box at checkout; (c) signing or replying "I accept" to an Invoice or quote; or (d) paying any Invoice, in whole or in part, by any method accepted in Section 7. Payment of an Invoice constitutes your express acceptance of this Agreement and of the cancellation conditions stated in that Invoice. If you do not accept these terms, do not pay, and contact us for clarification before booking.

1.4. Disclosure before payment. In compliance with Florida Statutes, Chapter 559, Part XI (Sellers of Travel), Progress Tours discloses the non-refundable nature of its Services in these Terms, on the website, and on every Invoice, before accepting any payment. You acknowledge that you received this disclosure before paying.

1.5. Electronic records and signatures. You agree that this Agreement, Invoices, confirmations, vouchers, and notices may be provided and accepted electronically, and that your electronic acceptance (including clicks, checkboxes, email replies, and online payment) has the same legal effect as a handwritten signature under the U.S. Electronic Signatures in Global and National Commerce Act (E-SIGN Act) and the Florida Uniform Electronic Transaction Act.

1.6. Changes to these terms. We may change these terms at any time by publishing the updated version on progresstours.com. Changes apply only to bookings made after publication and are never retroactive. The version in force on the date of your payment governs that booking.

2. Definitions

"Client" or "you": the travel agency, tour operator, or travel professional that books or pays for the Services in its own name for resale to its own customers (an "Agency"), or the individual or company that books and pays for the Services directly (a "Direct Client").

"Member": a Client holding a Progress Tours account.

"Passenger" or "traveler": each person named in a booking. Passengers booked by an Agency are customers of that Agency, not of Progress Tours.

"Invoice": the official document issued by Progress Tours from an @progresstours.com email address, identifying the Services, passengers, dates, price, payment instructions, and cancellation conditions.

"Payment Link": the secure electronic payment link for an Invoice, issued and sent to the payer by Progress Tours' authorized payment company, [PAYMENT COMPANY NAME] (the "Payment Provider").

"Supplier": any third-party hotel, transfer company, charter operator, vehicle rental company, airline, tour provider, or other company that actually provides a travel service.

"Circuits": the products in the Circuits category of progresstours.com.

"Booking": a reservation confirmed by Progress Tours after full payment has cleared.

3. Eligibility and Accounts

3.1. Minimum age. You must be at least 18 years old and legally able to enter into contracts to book or pay for the Services.

3.2. Accurate information. You agree to provide true, accurate, and complete information, including your real name, a valid email address, telephone number, and billing details, and to keep it updated. You may have only one Progress Tours account, which must be in your real name.

3.3. Account security. You agree to choose a strong password, keep it secret, and not share or transfer your account. You are responsible for all activity under your account until you close it or report misuse to tony@progresstours.com.

3.4. Travel agencies' obligations (B2B). An Agency buys the Services from Progress Tours in its own name and resells them to its passengers under its own contract and responsibility. An Agency agrees to:

  • inform its passengers, before taking any payment from them, of all conditions of this Agreement that affect them, especially the no-refund policy, the payment deadline, the age and accessibility rules, passenger names, documents, and Supplier rules;

  • pay Progress Tours in full and on time, whether or not the passenger has paid the Client;

  • be solely responsible to its passengers for the sale, its own prices and fees, consumer-protection obligations in the passenger's country, and any refund the Client chooses to grant from its own funds;

  • be responsible for its passengers' conduct and for any chargeback, complaint, or claim filed by its passengers against Progress Tours, and reimburse Progress Tours in full for any resulting loss;

  • hold all licenses, registrations, and authorizations required to sell travel in its own country.

3.5. Email accounts. It is the Member's responsibility to enter the correct email address. If our emails go to your Junk or Bulk folder, mark them as "not spam." Progress Tours is not responsible for communications not received because of an incorrect email address or spam filtering.

4. Bookings

4.1. Names of travelers. The person making the booking must enter the correct full names of all travelers exactly as shown on their passports, first name followed by family name. "TBA" or abbreviations are not accepted and may cause the hotel or Supplier to reject the booking without refund. Names cannot be changed after the booking is confirmed.

4.2. Nationality declaration. Declaring each traveler's nationality, as shown on the passport, is mandatory. If the nationality is not changed, the agency's nationality will be applied by default. Any financial loss caused by a false or incorrect nationality declaration is the full responsibility of the Client or Member, who will reimburse Progress Tours in full.

4.3. Room types. The Client is responsible for booking a room type suitable for the traveling party. If more people arrive at the hotel than the room can accommodate, the hotel may refuse the booking, and no refund will be due.

4.4. Bedding and preferences. Bedding, smoking, and other preferences are forwarded to the hotel as requests only and are subject to availability at check-in. Room assignment is made by the hotel.

4.5. Group bookings. A booking for 10 or more travelers is a group booking and must be requested at progresstours.com/getaquote. Progress Tours may cancel individual bookings made for a group, or bookings it reasonably believes were made to hold space for resale.

4.6. Check your voucher. After booking, you must check that all details on the voucher (traveler names, hotel name and address, city, dates, and services) are correct and notify us immediately of any error, before the cancellation deadline.

4.7. Leisure rates. All rates are valid only for the leisure market. If a hotel determines that a traveler is not traveling for leisure purposes, it may refuse the contracted rate and charge the traveler directly. Progress Tours is not responsible for such charges.

5. Products and Supplier Services

5.1. Hotel information. Progress Tours strives to present hotel information accurately but is not responsible for its accuracy, for facilities that may not be available during the stay, or for facilities that do not meet the traveler's personal taste. Photos give an overview only. The room allocated may belong to a different category and differ from the photos. Star ratings are provided by Suppliers and accepted in good faith.

5.2. Renovations and wear. Renovations and maintenance may occur without warning. Normal wear and tear is beyond our control. Progress Tours is not responsible for disturbance, inconvenience, accidents, or loss caused by the hotel, its management, or its staff.

5.3. Age requirements. Hotels require at least one guest to be 18 or older. Some U.S. states have higher limits. If any traveler is under 25, contact the hotel directly before booking.

5.4. Supplier changes. If the hotel booked is closed, overbooked, under maintenance, or cannot provide the rooms, the hotel or Supplier is responsible for providing alternative accommodation of a similar standard. Progress Tours will contact you by email.

5.5. Maps. Maps are for information only. Contact the hotel directly for the most current location and directions.

5.6. Transfers. Transfers can be booked separately or together with other Services, under these conditions:

  • No changes of any kind are accepted after confirmation (date, name, flight number, or vehicle type). Transfers are not changeable or refundable.

  • Valid and accurate flight details are mandatory at booking. Progress Tours is not responsible for service failures caused by incorrect or omitted information.

  • Quotes are valid for 24 hours. Tips are not included.

  • Regular service hours are 7:00 AM to 11:00 PM. Service outside these hours must be requested in advance and carries a 30% surcharge.

  • Maximum waiting time: 15 minutes for point-to-point transportation, and 1 hour and 15 minutes after landing for international flights. After the waiting time, the service is considered a no-show and is not refunded.

  • Vehicle capacity depends on the number of passengers and luggage. The standard allowance is 1 piece of luggage per person. Anything different must be arranged and paid in advance.

  • Prices sent by WhatsApp are valid only for immediate booking. Any later inquiry must be sent by email.

5.7. Visa support.

  • Progress Tours is not obliged to request visa support documents for bookings not paid in full.

  • Requests for visa support documents are subject to a US$10 fee, which is not refunded if the booking is cancelled.

  • Progress Tours will do its best but does not guarantee that a hotel will issue visa support documents, or that any visa will be granted.

  • Any hotel charge for visa documents must be paid by the Client directly to the hotel.

  • Denial of a visa, entry, or boarding does not entitle the Client to a refund.

5.8. Promotions. Promotions are offered in good faith, are subject to availability, and may be modified or withdrawn at any time without notice. Promotional bookings, including bookings with free nights or early-booking savings, cannot be changed, extended, reduced, or refunded, and a free night is never refunded. Black Friday 2026: the 15% discount on Christmas and New Year's trips and on transfers applies only to bookings made and paid from November 2 to November 28, 2026 (Miami time), for arrivals through December 31, 2026. It cannot be combined with other offers. During this promotion, transfers between Miami and Orlando in both directions are offered in a luxury SUV, and luxury cars carry up to 4 passengers.

5.9. Guided tours, circuits and group departures.

  • Tours and circuits are operated with Suppliers, as stated on each product page and Invoice.

  • Itineraries are subject to change because of weather, road or park closures, Supplier availability, or safety. We will offer a similar alternative where possible. The order of stops, times, and vehicles may change.

  • The meeting point and time are shown on the voucher. Late arrival or missing the departure is a no-show and is not refunded.

  • Minimum group size: [FILL IN, or delete this line if it does not apply]. If a departure does not reach the minimum, we will offer another date or a credit for the amount paid for that tour [CONFIRM: or a refund of that amount].

  • We may remove a passenger from a tour for unsafe, disruptive, or unlawful behavior, or for not meeting the requirements of the trip, without refund.

  • Travelers must be in a physical condition suitable for the trip and must tell us in advance about any condition that may affect it.

  • Luggage allowance: [FILL IN]. Travelers are responsible for their belongings.

5.10. Children and accessibility.

  • Children are accepted on all Progress Tours products except Circuits. Circuits do not accept children, and all travelers on a Circuit must be 18 or older. No refund is due for a booking that includes a child on a Circuit.

  • Progress Tours does not offer accessible rooms or accessible transportation. Travelers with reduced mobility, or who need an accessible room or vehicle, should not book. No refund is due for a booking made without reading this notice.

  • Hotels may have their own accessibility features, but Progress Tours cannot guarantee them.

5.11. Motorhome and motorcycle tours.

  • The driver must hold a valid driver's license [FILL IN: minimum age and any additional license or international permit]. Motorcycle tours require a motorcycle endorsement.

  • Security deposit: [FILL IN amount and when it is returned].

  • Damage, fines, tolls, fuel, mileage, cleaning, and traffic violations are the renter's responsibility. Insurance, deductible, and excluded damage: [FILL IN].

  • The rental conditions of the vehicle company also apply: [CONFIRM who rents the vehicles].

6. Prices, Taxes and Fees

6.1. Prices and exchange rates. Prices are quoted in U.S. dollars unless the Invoice states otherwise. Exchange rates change daily, and Progress Tours may update prices displayed on the site accordingly. Once a booking is paid and confirmed, later exchange-rate fluctuations will not change its price, and no refund is due for any rate difference.

6.2. Quote validity. Quotes are valid for 24 hours, or for the period stated in the quote, and are subject to availability until payment clears.

6.3. Pricing errors. Progress Tours may correct any error or omission in prices, including those introduced by a Supplier or local agent. If an error is found, you may choose to keep the booking at the correct price, cancel it, or, subject to availability, accept a suitable alternative. If you cancel for this reason, the amount paid for that Service is refunded.

6.4. Local taxes. Tourist, city, or municipal taxes may not be included. When they must be paid at the hotel, this will be indicated in the observations and on the voucher.

6.5. Resort fees. Some hotels in the USA charge a resort fee (typically US$10 to US$20 per room per night) payable directly to the hotel. Progress Tours has no control over these fees and is not responsible for them.

6.6. Hotel extra charges. Charges for incidentals (air conditioning, safe, minibar, TV rental, luggage room, spa, pool, parking, and similar) and compulsory gala dinner supplements during the Christmas and New Year season must be paid directly to the hotel. Progress Tours is not always informed of these charges and is not responsible for them.

6.7. Bank and card fees. Some card issuers charge an international transaction fee because the payment is processed in the United States. Wire transfers may carry bank and intermediary fees. Progress Tours does not add its own fee, but it is not responsible for fees charged by the payer's bank or card issuer. Members who use their customer's card must inform the customer of this.

7. Payment Policy

7.1. Accepted payment methods. Payment for all Services is accepted only against an official Progress Tours Invoice, by one of these methods: (a) the secure Payment Link issued by the Payment Provider, [PAYMENT COMPANY NAME]; (b) wire transfer to the bank account printed on the Invoice; or (c) Zelle to the business account and name shown on the Invoice. Progress Tours does not take card payments on its website and accepts no other method or channel unless the Invoice expressly states otherwise.

7.2. Wire transfers. The payer is responsible for all bank, intermediary, and currency-conversion fees, so that Progress Tours receives the full Invoice amount in U.S. dollars. The payer must include the Invoice number as the payment reference and send the proof of payment to tony@progresstours.com. Wire transfers, especially international ones, can take several days to clear. Send them early enough to be cleared within the deadline in Section 7.6.

7.3. Zelle. Zelle payments are sent only to the business account and name shown on the Invoice. Zelle payments are generally immediate and cannot be reversed by Progress Tours. Check the recipient name before you send.

7.4. Official Invoices. Official Invoices are sent only from an email address ending in @progresstours.com. Each Invoice includes an invoice number, the travelers' names, the Services, dates, total price, payment instructions, cancellation conditions, and a reference to these Terms. A Payment Link is sent by the Payment Provider from its own system and always shows the same invoice number and amount as the Invoice. If the invoice number or amount does not match, do not pay.

7.5. Protect yourself from scams. Progress Tours will never:

  • ask for your card number, security code, or banking passwords by phone, WhatsApp, text message, social media, or email;

  • send a payment request from a personal or free email account, from an unknown phone number, or through a company other than the Payment Provider named in the Invoice;

  • ask you to pay by gift card, cryptocurrency, or to a personal account, or to any bank account or Zelle address that is not printed on an official Invoice;

  • change payment details by message without issuing a new official Invoice.

Before sending a wire transfer for the first time, or if any payment detail looks different, confirm it by phone at +1 305 942 9832 or by email to tony@progresstours.com. Progress Tours is not responsible for payments made outside an official Invoice, or to any person or account not issued by Progress Tours.

7.6. Payment deadline. Every product and service in every category of progresstours.com must be paid in full in advance. Full payment must be received and cleared no later than 24 hours before the start of the product or service (tour, circuit, transfer, hotel, charter, concierge service, or any other service). Bookings made less than 24 hours before the start require immediate payment. If an Invoice provides for partial payments, the last installment is also due 24 hours before the start at the latest. The Invoice may set an earlier deadline. Progress Tours may cancel, without notice and without refund of any amount already paid, any booking that is not fully paid by the deadline.

7.7. When a booking is confirmed. A booking is confirmed only when (a) full payment has been received and cleared, and (b) Progress Tours has issued a written confirmation and voucher. Until then, prices and availability are not guaranteed. Payment Links expire on the date stated on the Invoice, and an expired or unpaid Invoice may be cancelled automatically.

7.8. Installments. Unless the Invoice states a different schedule, the full price is due at the time of payment. If an Invoice provides for installments and any installment is not paid on time, Progress Tours may cancel the booking, and amounts already paid will not be refunded.

7.9. Payer. The person paying must be authorized to use the account or card used. If a Payment Link is paid by card, the payer declares that he or she is the authorized cardholder and accepts the Cardholder Declaration (Annex B). Identity checks may be performed by the Payment Provider, and Progress Tours may also request identification before confirming the booking.

7.10. Card statement. A card payment through the Payment Link appears on the statement as PROGRESS TOURS. Members who use a customer's card must inform the customer of this, to avoid misunderstandings and disputes.

7.11. Invoice copies. You can get a copy of any Invoice by contacting tony@progresstours.com.

7.12. Taxes. Taxes are calculated based on the billing information you provide at the time of purchase.

8. Fraud Prevention and Identity Verification

8.1. Verification rights. To protect payers and Progress Tours against fraud, Progress Tours may, before or after payment and before issuing vouchers, require any of the following:

  • a valid government-issued photo ID of the payer and/or travelers;

  • the verification steps required by the Payment Provider or by the bank;

  • confirmation of the booking by phone or video call with the payer;

  • authentication by the card issuer (such as 3-D Secure);

  • proof that the billing address matches the card, or that the sending account belongs to the payer.

This security measure is not meant to cause inconvenience. It protects against misuse.

8.2. Refusal or cancellation for suspected fraud. Progress Tours may refuse, suspend, or cancel any booking, without liability, if verification is not completed within the time requested, or if it reasonably suspects fraud, unauthorized use of a card or account, identity theft, money laundering, or a breach of this Agreement. In that case, any amount received will be returned only to the original payment method, after deduction of non-recoverable Supplier costs, and only once the investigation is complete.

8.3. Records. You agree that Progress Tours may record and keep, as evidence of the transaction and of your acceptance: IP address, device and browser data, date and time stamps, acceptance clicks, Invoice delivery and opening records, email and WhatsApp messages, call recordings, IDs and authorizations provided, vouchers issued, and Supplier confirmations of use (such as hotel check-in or transfer completion). These records may be shared with payment processors, banks, card networks, and law enforcement to prevent fraud and respond to disputes.

8.4. Reporting. Progress Tours reports suspected fraud to its payment processor, the card networks, and the competent authorities, and may pursue civil and criminal remedies against anyone who commits or attempts fraud.

9. Chargebacks and Payment Disputes

This section applies to payments made by card through the Payment Link. Payments made by wire transfer or Zelle are final once received, and Section 10 applies to them.

9.1. Contact us first. If you have any problem with a charge or a Service, you agree to contact Progress Tours at tony@progresstours.com and allow at least 20 business days to resolve it before contacting your bank or card issuer.

9.2. Acknowledgment. You acknowledge that: (a) you authorized the charge; (b) the Services are custom travel arrangements purchased from third-party Suppliers on your behalf immediately after payment; (c) the no-refund policy was disclosed to you before payment; and (d) you accepted it by paying the Invoice.

9.3. Improper chargebacks. Filing a chargeback or payment dispute for a charge you authorized, for Services that were delivered or made available, or because you cancelled, did not show, or changed your plans, is a breach of this Agreement. In such cases:

  • Progress Tours will contest the dispute and submit to the card issuer this Agreement, the Invoice, your acceptance records, your communications, and proof that the Services were booked, delivered, or made available;

  • Progress Tours may immediately cancel any pending or future booking and suspend your account;

  • you will remain liable for the full price of the Services, plus chargeback fees, bank fees, collection costs, and reasonable attorneys' fees incurred by Progress Tours, to the extent allowed by law;

  • unpaid amounts may be referred for collection.

9.4. Members' responsibility. Members who book with their customers' cards are responsible for any chargeback filed by their customers and agree to reimburse Progress Tours in full.

9.5. Disputes resolved in our favor. If a chargeback is withdrawn or decided in Progress Tours' favor, the original charge stands, and fees incurred remain payable by the Client.

10. Cancellation, Amendment and No-Refund Policy

10.1. All sales are final. All bookings are non-refundable once payment is made, except as stated in Sections 6.3, 8.2, 10.3, 10.8 and 11.4. Progress Tours purchases the Services from Suppliers on your behalf immediately after payment, under conditions that do not allow refunds to Progress Tours. By paying the Invoice, you expressly accept that no refund, credit, or reimbursement will be due if you cancel.

10.2. No refund in any of these situations. No refund, total or partial, will be issued for:

  • cancellation by the Client for any reason, at any time, including before the travel date;

  • no-show, late arrival, early departure, or unused nights or services;

  • personal reasons, illness, injury, pregnancy, death of a family member, work obligations, or change of plans;

  • flight delays, cancellations, or missed connections not booked through Progress Tours;

  • denial of visa, entry, or boarding, or invalid, expired, or missing travel documents;

  • incorrect names, nationality, dates, or information provided by the Client;

  • refusal by a hotel or Supplier because of the Client's conduct, occupancy above room capacity, age requirements, or leisure-rate rules;

  • a booking made by or for a traveler who does not meet the age and accessibility rules in Section 5.10;

  • free nights, promotions, and discounted or early-booking rates.

10.3. Supplier deadlines. Where a Supplier's own conditions allow a cancellation without penalty before a deadline, that deadline and condition will be shown on the Invoice. Unless the Invoice expressly states a free-cancellation deadline, the booking is non-refundable from the moment of payment. Any amount that a Supplier actually returns to Progress Tours may be credited or refunded at Progress Tours' sole discretion, less processing, banking, and administrative fees.

10.4. How to cancel or change. All cancellations and change requests must be sent in writing by email to tony@progresstours.com, or through your Progress Tours account, before the deadline for that product. Cancellations after the deadline are not accepted, and the full price is charged. The time of your request is the time it is received by Progress Tours.

10.5. Changes. Only one change per booking may be requested, and it is subject to Supplier approval and availability. Changes may result in a new price, plus change fees, payable through a new Invoice before the change is confirmed. Names, transfers, and promotional bookings cannot be changed. For further changes, the booking must be cancelled (without refund) and rebooked.

10.6. Changes made directly with Suppliers. Progress Tours is not responsible for changes or cancellations made directly with the hotel or Supplier.

10.7. Special conditions. During special events, specific dates, peak seasons, and early-bird bookings, Suppliers may apply stricter conditions, which will be disclosed to you as soon as Progress Tours is notified.

10.8. Cancellation by Progress Tours. If Progress Tours or a Supplier cancels a confirmed Service for reasons attributable to them, and no equivalent alternative of similar standard is offered and accepted, Progress Tours will refund the amount received for that specific Service, which is the Client's sole and exclusive remedy.

10.9. Travel insurance strongly recommended. Because bookings are non-refundable, Progress Tours strongly recommends that all travelers purchase comprehensive travel insurance covering trip cancellation, interruption, medical expenses, and baggage before paying. Declining insurance is the Client's decision and does not change this policy.

11. Responsibility and Limitation of Liability

11.1. Role of Progress Tours. Progress Tours is a receptive tour operator. It arranges services provided by independent Suppliers in the United States and, where the product page or Invoice states so, operates certain tours itself. Progress Tours has no sales contract with an Agency's passengers; the Agency is solely responsible to them for its own sale. Suppliers are not employees or agents of Progress Tours, and Progress Tours is not responsible for their acts, omissions, defaults, or negligence, or for any injury, damage, loss, delay, or expense arising from their services, to the extent allowed by law.

11.2. Traveler responsibility. Each traveler is solely responsible for valid passports, visas, health certificates, vaccinations, and entry requirements, and for arriving on time for all Services.

11.3. No warranty. TO THE EXTENT ALLOWED BY LAW, PROGRESS TOURS AND THOSE IT WORKS WITH (A) DISCLAIM ALL IMPLIED WARRANTIES AND REPRESENTATIONS, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND ACCURACY OF DATA; (B) DO NOT GUARANTEE THAT THE WEBSITE OR SERVICES WILL FUNCTION WITHOUT INTERRUPTION OR ERRORS; AND (C) PROVIDE THE WEBSITE AND ITS CONTENT ON AN "AS IS" AND "AS AVAILABLE" BASIS. SOME LAWS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME MAY NOT APPLY TO YOU.

11.4. Force majeure and weather. Progress Tours is not liable for any failure or delay caused by events beyond its reasonable control, including flood, earthquake, hurricane, adverse weather, fire, riot, war, terrorist acts, strikes, epidemics or pandemics, acts or orders of governments or authorities, border closures, and failures of Suppliers, airlines, or utilities. Such events do not give rise to a refund, except that if Progress Tours itself cancels a tour for weather or safety reasons, it will offer another date or a credit for the amount paid for that tour [CONFIRM: or a refund of that amount].

11.5. Limitation of liability. TO THE EXTENT ALLOWED BY LAW, PROGRESS TOURS' TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THIS AGREEMENT OR THE SERVICES IS LIMITED TO THE AMOUNT ACTUALLY PAID TO PROGRESS TOURS FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM. PROGRESS TOURS IS NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST ENJOYMENT, OR EMOTIONAL DISTRESS.

11.6. Indemnification. You agree to indemnify and hold Progress Tours, its owners, employees, and affiliates harmless from any claim, loss, or expense (including reasonable attorneys' fees) arising from your breach of this Agreement, false information, fraud, chargeback, or the conduct of the travelers you booked for.

12. Complaints

12.1. Any complaint that cannot be resolved at the hotel or with the Supplier during the trip must first be raised locally, and a copy signed by the hotel manager or Supplier should be obtained.

12.2. The complaint must then be sent to Progress Tours, with supporting documents, by email to tony@progresstours.com within 20 days after the end of the Service. Complaints received after this period may not be accepted.

12.3. Progress Tours will forward claims to the relevant Supplier. Response times vary from 5 to 20 business days depending on the nature of the claim. Any compensation depends on what the Supplier agrees to pay.

13. Use of the Website

13.1. You agree to comply with all applicable laws, provide accurate information, and use the Services professionally and lawfully.

13.2. You agree not to:

  • use stolen, unauthorized, or third-party payment cards or accounts without authorization;

  • make speculative, false, or duplicate bookings, or bookings to hold space for resale;

  • use bots or automated methods to access the Services, extract prices, or send messages;

  • monitor the Services for competitive purposes, or copy, frame, or mirror the website;

  • override any security feature, or overload the Services (spam, denial of service, viruses);

  • impersonate Progress Tours, or send messages or payment requests in its name.

13.3. Intellectual property. The progresstours.com website, its content, the Progress Tours name, and its logo belong to Progress Tours or its licensors and may not be used without written permission.

13.4. Suspension. Progress Tours may restrict, suspend, or terminate any account or booking if it believes you are in breach of this Agreement or the law, or are misusing the Services.

14. Privacy Policy and Communications

14.1. Information we collect. We collect the information you give us to quote, book, and deliver the Services: names, contact details, passport and nationality data, travel dates, preferences, and billing details. If you use the Payment Link, the Payment Provider collects your payment data. We also collect technical data from the website, such as IP address, device and browser data, and cookies.

14.2. How we use it. We use your information to provide and confirm the Services, communicate with you, prevent fraud, meet legal obligations, and improve our website and services.

14.3. Who we share it with. We share travelers' data with Suppliers only as needed to provide the Services, and with payment providers, banks, card networks, and authorities as described in Section 8. We do not sell your personal information.

14.4. Cookies and analytics. The website uses cookies and analytics tools to work properly and to understand how it is used. You can control cookies in your browser settings.

14.5. Security and retention. We use reasonable measures to protect your data. We keep it only as long as needed for the purposes above and as required by law.

14.6. Your rights. You may ask to access, correct, or delete your personal data, subject to legal retention duties. This includes travelers in Europe and Brazil. Send your request to tony@progresstours.com.

14.7. Call recording. Telephone calls to Progress Tours may be recorded to monitor and improve our services and as evidence of bookings. We will tell you at the start of a call if it is being recorded.

14.8. Notices. We may send you notices through a banner on the website, by email to the address you provided, or by phone, text, or mail. To stop promotional emails or newsletters, write to tony@progresstours.com. Service messages about your bookings will still be sent.

15. Termination

Either you or Progress Tours may terminate this Agreement at any time with notice to the other. Termination does not cancel bookings already paid, does not create any right to a refund, and does not affect amounts owed. Sections 7 to 12, 15, and 16 survive termination.

16. Governing Law, Dispute Resolution and General Terms

16.1. Governing law. This Agreement and any dispute relating to it or to the Services are governed exclusively by the laws of the State of Florida, U.S.A., excluding its conflict-of-law rules.

16.2. Jurisdiction. All claims may be litigated only in the federal or state courts located in Miami-Dade County, Florida, USA, and you and Progress Tours consent to the personal jurisdiction of those courts.

16.3. Waiver of jury trial and class actions. TO THE EXTENT ALLOWED BY LAW, YOU AND PROGRESS TOURS WAIVE ANY RIGHT TO A JURY TRIAL, AND ANY CLAIM MUST BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION.

16.4. Time limit. Any claim must be filed within one (1) year after the travel date of the Service concerned, to the extent allowed by law.

16.5. Severability. If a court finds any part of this Agreement unenforceable, the court should modify it to make it enforceable while achieving its intent. If that is not possible, that part will be removed and the rest of the Agreement will remain in force.

16.6. Language. Progress Tours is a company established in the United States, and its website, this Agreement, Invoices, vouchers, and communications are provided in English. By registering, booking, or paying, the Client declares that it reads and fully understands English, or that it had the opportunity to obtain a translation or professional advice before accepting, and that it voluntarily chose to contract in English. The Client is responsible for translating these conditions for its passengers when needed. Any translation is for convenience only, and the English version always prevails.

16.7. Entire agreement. This Agreement, including the Invoice and product conditions disclosed before payment, is the only agreement between you and Progress Tours regarding the Services and supersedes all prior agreements, quotes, and messages.

16.8. No waiver; assignment. If Progress Tours does not enforce a breach, it does not waive its right to do so later. You may not assign this Agreement or your bookings without our written consent. Progress Tours may assign this Agreement to its affiliates or to a buyer of its business without your consent. There are no third-party beneficiaries.
